Perspective 04 / Source-led drafting

A strong draft has a visible path back to its sources.

Bring the record, the law and counsel’s judgment into the work product together.

Sources. Context. Judgment.
Carried through the work.

Prepare the drafting brief

The drafting stage should inherit the matter’s objectives, party role, procedural context, approved facts, issues, strategy and authority set. It also needs the firm’s preferred form, voice and review requirements. These inputs help a specialist produce the right work product for the matter rather than a plausible generic document.

Missing instructions should remain visible. If a key date is disputed or a requested assertion lacks support, the workflow should surface the gap for counsel. It should not turn uncertainty into a confident sentence merely to complete the draft.

Separate quotation, fact and argument

Relevant quotations from the record, legislation and judgments should preserve the source wording and a precise location. Translations should be identified and linked to the original. Extracted facts should carry evidence references; counsel’s inferences and legal arguments should remain distinguishable from what a source actually says.

Source-led drafting does not mean reproducing every document verbatim. It means selecting what is material, quoting accurately where a quotation is used and making the evidential basis of each important proposition inspectable. The lawyer should be able to move from a sentence in the draft to the passage behind it.

Check the work in more than one way

A verification pass can compare quotations, party names, dates, amounts, defined terms and cross-references against the record. It can identify unsupported propositions, missing citations and inconsistencies between sections. The draft should also be checked against the approved authority set and the firm’s document requirements.

Those checks support legal review; they do not establish that a document is strategically sound or suitable for filing. Counsel must review the reasoning, treatment of contrary material, requested relief and the final form. Readiness should reflect completed checks and explicit approval, rather than the mere existence of a generated file.

Release a version, retain its context

The approved document should be released through a controlled channel, such as the client portal, with the intended audience and permissions. Retain the source versions, instructions and review decisions used to produce it. Internal research notes and unreleased drafts should stay within their agreed access boundary.

When the record changes, flag affected work before reuse. A precedent library can preserve useful structure and approved drafting choices while keeping matter-specific facts and confidential information appropriately separated. AgenticStride helps firms turn these principles into templates, review routines and practical implementation criteria that their teams can sustain.
